Frequently Asked Questions

How is a lithium-ion battery pack classified—under primary cells (8506) or storage batteries (8507)?

Lithium-ion battery packs are rechargeable and therefore classified under 8507 (electric storage batteries), not 8506, which covers non-rechargeable primary cells and batteries. The distinction turns on whether the electrochemical system is designed for a single discharge cycle or for repeated recharging.

What determines whether a communications module is classified under 8517 versus 8543?

Heading 8517 covers apparatus for the transmission or reception of voice, images, or data, including telephone handsets, routers, and modems. Heading 8543 is a residual provision for electrical machines with individual functions not covered elsewhere; a module that clearly performs a transmission or reception function belongs in 8517, while a specialized electrical device without a more specific heading may fall under 8543.

Does electronic waste and scrap have its own classification in this chapter?

Yes—heading 8549 specifically covers electrical and electronic waste and scrap, including spent batteries and circuit board scrap. Importers of such material should also be aware that EPA regulations and, in some cases, Basel Convention obligations may govern transboundary movement of electronic waste.
