Bars and rods produced solely by sintering — without subsequent mechanical working such as swaging, rolling, or drawing — are classified as unwrought under 8101940000. Once a sintered bar undergoes further mechanical deformation that changes its grain structure or dimensions, it crosses into wrought territory and is classified under HTS 8101991000. The distinction often requires a manufacturing process declaration from the supplier.

Goods manufactured in Vietnam from Vietnamese-origin tungsten are not subject to Section 301 tariffs. However, if the tungsten intermediate (such as APT or oxide) was produced in China and merely processed in Vietnam, CBP may find that origin remains China, triggering Section 301 liability. Importers should obtain detailed manufacturing affidavits and consider requesting a CBP binding ruling to confirm origin before committing to a supply arrangement.
