Fresh or Chilled Boneless Certified Organic Beef Cuts (US Note 3, Non-Processed)

Imported beef must be certified by a USDA-accredited certifying agent or by a foreign certifying agent recognized under a USDA organic equivalency arrangement. Documentation such as a valid organic certificate and transaction certificates must accompany the shipment.

As of the most recent arrangements, the US has organic equivalency agreements with Canada, the European Union, Japan, South Korea, Switzerland, Taiwan, and the United Kingdom. Beef from these countries certified under their respective organic programs may qualify for import as certified organic.

Certified organic beef under this subheading may have a distinct duty rate or TRQ allocation compared to conventional beef subheadings. Importers should consult the current USITC HTS and CBP guidance to confirm whether preferential rates apply to organic beef from specific origins.
