Homogenized Fruit Preparations (Baby Food & Similar)

Subheading note 2 to Chapter 20 defines homogenized preparations as finely homogenized mixtures of two or more fruits, put up for retail sale as infant food or for dietetic purposes, in containers of 250 g or less. Single-fruit purees or those in larger containers generally do not qualify and would instead fall under heading 2007 (jams/purees) or 2008 (other prepared fruit). Verifying that the product meets both the composition and packaging criteria is essential before using this subheading. Consult a licensed customs broker for borderline products.

Chile has an equivalency arrangement with the USDA National Organic Program, meaning certified organic products from accredited Chilean certifiers can be marketed as organic in the US without re-certification. Importers must nonetheless retain the organic certificate issued by the Chilean certifying agent and ensure the product's NOP-equivalent status is documented at entry. FDA food facility registration and any applicable labeling requirements for infant-directed products apply regardless of organic status.
