Specimens of extinct or endangered species — including fossils of CITES-listed taxa — may require CITES permits from both the exporting country and US Fish & Wildlife Service. Even specimens not currently CITES-listed may be subject to the Endangered Species Act or Lacey Act if they involve protected wildlife. Importers should confirm permit requirements with USFWS before shipment.
Archaeological and ethnographic pieces under subheading 970510 from countries with bilateral cultural property agreements with the US may be subject to import restrictions under the Convention on Cultural Property Implementation Act. CBP enforces these restrictions at the border, and importers must be able to document that the article was legally exported from the source country. Provenance documentation is essential for this subheading.
