Heading 8800 is a US-specific provision that consolidates civilian aircraft, engines, and parts eligible for duty-free treatment under the Agreement on Trade in Civil Aircraft (ATCA). To claim this treatment, the importer must file a declaration of intended use, and the goods must be used in civil aviation. Military aircraft and parts do not qualify.
Heading 8806 specifically covers unmanned aircraft, including remotely piloted and autonomous drones of all sizes. Classification there is appropriate for the aircraft itself; cameras, sensors, or other payloads attached to the drone may be separately classified under their own headings if imported separately, but as part of a complete drone system they are generally classified with the aircraft.
Parts identifiable as suitable for use solely or principally with aircraft of headings 8801, 8802, or 8806 are classified under 8807. However, parts more specifically described elsewhere—such as aircraft engines classified under the machinery chapter, or avionics under the electrical machinery chapter—follow those more specific provisions. The Section XVII legal notes govern the boundary.
