North American Industry Classification System
Yes. The Lacey Act plant declaration applies to all plant material, including bulk commodities like wood chips, bark, and sawdust. Importers must identify the genus and species of the plant material to the best of their knowledge, even for low-value bulk shipments. CBP and USDA periodically update which product categories require immediate versus phased declaration.
Buyers typically rely on chain-of-custody certification from recognized forest certification schemes, supplier declarations, and third-party audits. While certification is not a legal substitute for Lacey Act compliance, it provides documented due care that can mitigate penalty exposure if illegal harvest is later alleged. Importers should also retain harvest-origin records for at least five years.
