Antidumping and countervailing duty orders are typically scoped to specific HTS lines and product descriptions. Orders covering frozen warm-water shrimp (030617) do not automatically extend to fresh or chilled shrimp (030636), but the scope language of each order must be reviewed carefully. CBP scope rulings can determine whether a fresh or chilled product falls within an order's coverage. Importers should obtain a scope ruling or consult a licensed customs broker before assuming fresh shrimp is outside the scope of any applicable order.

Fresh and chilled shrimp sold at retail in the US must comply with COOL (country-of-origin labeling) requirements administered by USDA AMS, as well as FDA labeling regulations covering product identity, net weight, and allergen disclosure. If the shrimp has been treated with sodium tripolyphosphate or other additives, those must be declared on the label. Importers supplying retail channels should confirm labeling compliance with both FDA and USDA AMS requirements before distribution.
