For seafood, US customs generally applies a 'substantial transformation' test: if the processing in the second country (e.g., cleaning, tenderizing, and freezing in Spain) substantially transforms the raw octopus into a new and different article of commerce, the country of processing may be the country of origin for duty purposes. However, USDA COOL retail labeling rules require disclosure of both the country where the fish was harvested and the country where it was processed. Importers should consult a licensed customs broker to determine the applicable origin rule for their specific supply chain.

FDA most frequently flags frozen octopus for decomposition (histamine or sensory evidence of spoilage), filth, and in some cases Listeria monocytogenes in ready-to-eat tenderized product. Importers should require that foreign processors document their HACCP critical control points for freezing temperature and sanitation, and should consider third-party audits for high-volume suppliers.
