The classification does not depend on whether the windshield is original equipment or a replacement part — the determining factors are the laminated construction and the motor-vehicle dimensional fit. Importers of aftermarket windshields should ensure invoices specify the laminated construction to avoid misclassification.

The most common interlayer is polyvinyl butyral (PVB), but other polymer films and cast-in-place resins are also used. The key requirement is that the glass plies are permanently bonded through the interlayer under heat and pressure, creating a composite that holds together on breakage. A glass assembly held together only by a removable film or adhesive tape would not qualify as laminated safety glass under heading 7007.
