Dried egg albumin derived from eggs is an egg product subject to USDA FSIS jurisdiction under the Egg Products Inspection Act. It must originate from an FSIS-approved foreign establishment and is subject to reinspection at the port of entry. Milk albumin and whey protein concentrates, by contrast, fall under FDA oversight as dairy-derived food ingredients.

Subheading 350220 within heading 3502 specifically captures concentrates containing more than 80% whey protein calculated on a dry-matter basis — a high-protein fraction that has been further processed beyond standard whey. Products below that protein threshold generally remain in Chapter 4.
