For tariff classification purposes, heading 3503 covers gelatin regardless of whether it is derived from bovine hides, porcine skin, or fish — species origin does not change the HTS classification. However, species origin is commercially and regulatorily significant: porcine gelatin may be restricted in certain markets, and CITES considerations can apply to gelatin derived from protected species. Accurate declaration of source species is important for admissibility.
Both food-grade and pharmaceutical-grade gelatin classify under heading 3503, but pharmaceutical-grade gelatin used in capsule shells or drug formulations is regulated as a drug component by FDA and must meet USP or equivalent standards. Food-grade gelatin is regulated as a food ingredient. The grade and intended use must be accurately declared, as FDA may examine shipments of either type at entry.
