Pesticides imported into the US must be registered with the EPA under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), or qualify for a specific exemption. Unregistered pesticides are generally inadmissible, and importers may be required to submit a Notice of Arrival to EPA. Products that are identical to a registered pesticide but manufactured abroad may still require a separate registration or an approved supplemental distributor arrangement.

Agricultural machinery sourced from countries subject to Section 301 tariff actions may carry additional duties on top of the standard MFN rate. The applicability and scope of these measures depend on the specific HTS classification of the equipment and the country of origin. Importers should conduct a tariff classification review and monitor USTR exclusion lists, as product-specific exclusions have been granted and revoked over time.
