Frozen Oysters

CBP generally looks to whether the oysters were cultivated in a controlled aquaculture environment — such as rack-and-bag, longline, or bottom culture — as opposed to harvested from wild populations. Aquaculture certification documents, farm registration records, or a harvest certificate from the exporting country's competent authority are the most reliable supporting documentation for the farmed subheading.

South Korea is a US free-trade-agreement partner under KORUS, and eligible frozen oysters of South Korean origin may qualify for preferential tariff treatment under that agreement. Importers should confirm the applicable KORUS staging category and ensure that a valid certificate of origin or other qualifying documentation accompanies the shipment.
