Machines specifically designed for filling, sealing, labeling, or capping containers — including aerating beverage machines — are classified under their own dedicated headings rather than the NES category. Similarly, vacuum-packaging machines and form-fill-seal machines may have more specific classifications depending on their primary function. Confirming that no specific heading applies is the first step before using the NES code.

Duty rates can differ between the NES heading and more specific machinery headings, so misclassification carries financial risk in both directions. Importers should obtain a detailed functional description from the manufacturer and, where the classification is uncertain, seek a CBP binding ruling to lock in the correct heading before the first shipment.
