North American Industry Classification System
Basic chemical production is highly capital-intensive with significant economies of scale, making it susceptible to below-cost pricing by state-supported foreign producers. The US has active antidumping and countervailing duty orders on numerous basic chemicals — including certain acids, soda ash, and chlorinated compounds — from multiple countries. Importers should check the USITC and Commerce Department databases for active orders before sourcing.
Purity is a critical classification variable for basic chemicals under HTS Chapters 28 and 29. For example, inorganic compounds must often meet a minimum purity threshold to qualify for a specific 'chemically pure' subheading; below that threshold, the product may be classified as a mixture or preparation under a different heading with a different duty rate. Certificates of analysis from the supplier are essential documentation for accurate classification.
