Headings 3208 and 3209 specifically cover paints and varnishes based on synthetic polymers or chemically modified natural polymers. A paint whose binder is an unmodified natural oil (such as linseed oil), a natural resin (such as shellac), or another non-synthetic base falls outside those headings and into 3210 as a residual category. The chemical nature of the film-forming binder is the controlling distinction.
Leather finishing pigments are industrial chemical preparations and do not trigger mandatory admissibility review by food or drug agencies. They enter under standard CBP procedures. However, if the preparation contains hazardous substances, importers should review EPA Toxic Substances Control Act (TSCA) requirements and ensure any applicable chemical reporting obligations are met.
