Rolled or Flaked Oat Grains

Steel-cut oats are produced by cutting groats with steel blades without rolling, placing them in heading 1103 as oat groats or meal. Rolled and flaked oats — steamed and passed through rollers to flatten the kernel — are classified under heading 1104. The physical form (cut vs. flattened) is the determining factor, and importers should obtain a product specification sheet from the supplier confirming the processing method.

To enter under the certified organic line, the product must be certified by a USDA-accredited certifying agent or by a foreign certifying agent recognized under a USDA equivalency arrangement. The importer must retain the organic certificate, transaction certificates, and chain-of-custody documentation. CBP may request these records at entry, and USDA's Agricultural Marketing Service can audit organic import claims. Misuse of the organic line without valid certification can result in penalties and reclassification.
