Original paintings, drawings, and pastels executed entirely by hand typically qualify under fine-arts provisions, while photographic prints produced in large runs and sold as décor items generally remain classified as pictures or photographs under this heading.

For high-value or limited-edition photographic works, importers should obtain a written appraisal from a qualified art appraiser and include it with the entry documentation. The appraisal should reference the edition number, total edition size, artist, and comparable sales. This supports the declared transaction value and reduces the risk of a CBP value query or reappraisement.
