Most ophthalmic diagnostic instruments — including slit lamps, tonometers, and retinal cameras — are Class II medical devices requiring 510(k) premarket notification clearance. The foreign manufacturer must also be registered with FDA and have the device listed. Instruments imported for investigational use may qualify under an Investigational Device Exemption (IDE), but commercial distribution without clearance is prohibited.

CBP applies a substantial transformation test: the country where the last substantial transformation occurred — typically where the instrument is finally assembled, calibrated, and tested as a functional unit — is the country of origin. If optical elements from Germany are integrated into a finished instrument in Japan, Japan is generally the country of origin. Detailed manufacturing records and a CBP binding ruling are advisable when components cross multiple borders.
