FDA permits sodium nitrite as a food additive in cured meats at strictly controlled maximum levels under 21 CFR. Importers of food-grade sodium nitrite should provide a Certificate of Analysis confirming purity, a supplier declaration of food-grade status, and an FDA food facility registration for the foreign manufacturer. Given the food-additive classification, admissibility review applies — consulting a licensed customs broker with food chemical experience is advisable before the first shipment.

While both grades fall under the same trade heading, commingling or misrepresenting grades on a single entry creates significant regulatory and liability risk. Food-grade material must meet higher purity thresholds and carry appropriate documentation; technical-grade material shipped without food-grade certification cannot be diverted to food applications. Importers should maintain strict lot segregation and grade-specific documentation to avoid FDA enforcement action or product liability exposure.
