The key is that the article must be a clothing accessory or garment part, not a complete garment.

The importer should prepare a classification worksheet showing that each more specific heading in the chapter was considered and ruled out, citing the relevant chapter notes and heading descriptions. Supporting documentation — such as product specifications, photographs, and the article's commercial name — helps demonstrate that the N.E.S. provision is the correct landing point.
