CBP uses this standard to determine whether a returned US-origin article qualifies for duty-free reimportation. If the goods were repaired, upgraded, or otherwise enhanced while abroad — even if the work was minor — they may be considered 'improved in condition' and subject to duty on the value of the foreign processing. Goods returned in the same state as exported, such as unsold inventory or items returned due to defects, generally meet the duty-free standard.
CBP does not impose a strict statutory time limit for most returned goods claims, but extended periods abroad can raise questions about whether the goods have been altered or whether the US-origin claim remains valid. Practically, importers should be prepared to provide contemporaneous export documentation regardless of how long the goods were outside the US, as older records are harder to produce and may be scrutinized more closely.
