CBP looks primarily at whether the device is freely programmable, capable of executing a user-supplied program, and able to perform a variety of computations without hardware modification. Devices designed for a single dedicated function — such as a gaming console or a specialized industrial controller — may not qualify as ADP machines and could be classified under a different chapter with a different duty rate.

Section 301 tariffs on Chinese-origin computers prompted many manufacturers to expand or shift final assembly to Vietnam, Mexico, India, and other countries. However, country-of-origin rules require substantial transformation, so importers must verify that assembly operations in the new location are sufficient to confer non-Chinese origin before claiming a different tariff treatment.
