North American Industry Classification System
CBP frequently flags misclassification of knit versus woven construction, incorrect fiber content declarations, and misidentification of garment type (e.g., classifying a jacket as a vest, or a dress as a skirt). These errors affect duty rates and can trigger penalties, so importers should obtain and retain manufacturer certifications and, for high-volume lines, consider requesting a binding ruling.
Section 301 tariffs on Chinese-origin apparel apply on top of already-elevated column 1 duty rates, significantly increasing landed costs for garments sourced from China. Many importers have responded by shifting production to Vietnam, Bangladesh, Cambodia, and other countries not subject to Section 301 measures, though capacity constraints and lead-time differences remain practical considerations in those markets.
